Foreclosure cases are overwhelming the Lee County court system. Since January 2006, 32,665 foreclosures were filed. Charlie Green, the Clerk of Courts, says 11,558 have been resolved and 21,107 are pending. "It's a situation we've never seen before," Green said Tuesday during a Lee County Board of Commissioners meeting.

Most foreclosures linger in the system for about six months, according to a courthouse employee. All this extra work on foreclosures requires the court to put other civil matters on hold.

Now, the court plans to devote a courtroom three days a week to hear nothing but foreclosure cases. According to Green, one in 64 houses in Lee County is in foreclosure. by NBC2 NEWS.

Foreclosure crisis going to get worse before it gets better

Government officials and homeowners are hunkering down. If the foreclosure crisis is bad now, the increasing trend of court filings indicates the problem will become much worse, experts say.

The storm has been brewing for at least the last five years, and the next two years could be critical. No one can predict how deep the crisis will go, said Michael Seng, a John Marshall Law School professor and executive director of the school's Fair Housing Program.
"We're just seeing the tip of the iceberg now," Seng said.

Already this year, the numbers of foreclosures in most of the Northwest and West suburbs have met or exceeded last year's totals. Local academics and researchers have been keeping tallies and raising red flags, with some hoping government officials will take action. By Anna Marie Kukec Daily Herald Staff

Foreclosure filings surge 55% over July '07

The number of homeowners stung by the slumping housing market jumped last month as foreclosure filings were 55% higher than a year ago, according to data released Thursday.

Nationwide, more than 272,000 homes received at least one foreclosure-related notice in July, up from about 175,000 in the same month last year and up 8% from June, RealtyTrac said. That means one in every 464 U.S. households received a foreclosure filing last month.

RealtyTrac, based in Irvine, Calif., monitors default notices, auction sale notices and bank repossessions. More than 77,000 properties were repossessed by lenders in July, the company said. If your ready for a change email us.

Nevada, California, Florida, Arizona, Ohio, Georgia and Michigan had the highest foreclosure rates. Foreclosure filings increased from a year earlier in all but eight states.

The combination of weak home sales, falling home values, tighter mortgage lending criteria and a slowing economy has left financially strapped homeowners with few options to avoid foreclosure. Equity in Americans’ homes falls to historic low

NEW YORK - The equity Americans have in their most important asset — their homes — has dropped to its lowest level since the end of World War II.

Homeowners’ portion of equity slipped to 46.2 percent in the first quarter from a revised 47.5 percent in the previous quarter. That was the fifth quarter in a row below the 50 percent mark, the Federal Reserve said Thursday.

The total dollar value of equity also fell for the fourth straight quarter to $9.12 trillion from $9.52 trillion in the fourth quarter, while Americans’ total mortgage debt rose to $10.6 trillion from $10.53 trillion.

A homeowner’s equity is the market value of a property minus the mortgage debt. And homeowners’ percentage of equity has declined steadily even as home values surged during the housing boom due to a jump in cash-out refinancing, home equity loans and an increase in 100 percent financing.

Experts expect equity to decline further as falling home prices erode the value of Americans’ largest asset, dragging more homeowners “upside down” on their mortgages.

At the end of March, nearly 8.5 million homeowners had negative or no equity in their homes, representing more than 16 percent of all homeowners with a mortgage, according to Moody’s Economy.com Chief Economist Mark Zandi. By June 2009, he estimates that will increase to 12.2 million, or almost one out of every four homeowners with a mortgage.

But to put that number in perspective, one out of every three homeowners own their properties free and clear, with no mortgage at all.

Still, Zandi said, “For most, their home is their key asset. If they have no equity in their home, likely their net worth is negative too. Their entire balance sheet will be underwater.”

The report also showed that Americans’ total net worth dropped to $55.97 trillion in the first quarter from $57.67 trillion.

Zandi expects prices to fall 24 percent from peak to trough. Last week, Standard & Poor’s/Case-Shiller said its national home price index fell about 14 percent in the first quarter compared with a year earlier, the lowest since its inception in 1988.

Prices nationwide are at levels not seen since the third quarter of 2004.

Homeowners with no or negative equity are more likely to fall behind on their mortgage payments or, in frustration, mail the keys to the lender and walk away from their mortgages, a phenomenon more lenders are seeing. This will only increase foreclosures, which have been surging the last two years, and further exacerbate the housing downturn.

a 'short sale' but I'm not sure what a short sale is.
Answer: A short sale is when in order to sell the property before foreclosure a settlement of

Question: How long does it take for a short sale to be completed.
Answer: Once all documents have been submitted, it should take between 1-3 months,
depending on the bank.

Question: What documents will I need.

Question: But do you think that the lender is going to accept less than what I owe.

Answer: The short sale will take some time so you have the opportunity to plan when and

Question: How will I find a realtor?

cancelled and continuances optained so that the short sale process can

Question: My home need repair. I can't afford any right now.
Answer: You should not make any repairs what so ever. The bank is more inclined to
negotiate a short sale if your home needs repair. You will, however, need to get a
home inspection report along with estimates. We will assist you in locating an
inspector so that we can attach this report to the paperwork we submit to the bank.

Question: Will I ever be able to be a homeowner again?
Answer: Do not dispair, yes. If you had a foreclosure or a deed-in-lieu, it would be up to 36
months before you would be considered by a lender for a new loan. With a short
sale your wait is a lot less. Within 18-24 months you should be able to buy again at a
decent rate of interest.
